40 CFR Part 61, Subpart M (§ 61.145) — National Emission Standard for Asbestos (NESHAP)
The federal Asbestos NESHAP (40 CFR Part 61, Subpart M; § 61.145 "Standard for demolition and renovation") sets Clean Air Act work-practice standards for demolition and renovation of all covered facilities — i.e., any structure or building except residential buildings with four or fewer dwelling units (so residential buildings with five or more units, and non-residential buildings, are covered). The owner/operator must thoroughly inspect the affected facility for asbestos before work, give written notice to EPA or the delegated state authority before any demolition (and before renovations that meet the regulated-ACM thresholds of at least 260 linear feet on pipes, 160 square feet on other facility components, or 35 cubic feet off facility components), and remove, adequately wet, and dispose of regulated asbestos-containing material using prescribed emission-control practices. It is enforced by EPA/the delegated authority (in New York, the State DEC) and operates alongside New York City's own asbestos rules; it is a federal standard, not an NYC DEP rule.
