NYC Admin. Code § 24-168.1 (Clean heating oil)
NYC Admin. Code § 24-168.1 ("Clean heating oil"), part of the Air Pollution Control Code's fuel standards (Title 24, Ch. 1, Subch. 8) administered by the Department of Environmental Protection, requires that heating oil (grades No. 2, No. 4, and No. 6) used in buildings in the city contain a minimum percentage of biodiesel by volume, escalating over time (2% from Oct. 1, 2012 under Local Law 43 of 2010; raised by Local Law 119 of 2016 to B5 in 2017, B10 in 2025, B15 in 2030, and B20 in 2034). Emergency generators are exempt, and the commissioner may grant temporary waivers based on biodiesel supply, pricing, equipment warranty, or applicable testing-standard considerations.
