Under the NYC Air Pollution Control Code (Admin. Code Title 24, Ch. 1), owners of fuel-burning boilers and water heaters must register or obtain a Certificate to Operate from DEP: equipment with a heat input of 350,000 Btu/hr or more (individually, or in the aggregate per building) but less than 4.2 million Btu/hr requires registration (§ 24-109), while equipment at or above 4.2 million Btu/hr requires an operating certificate (§ 24-122); both are valid for up to three years. Separately, under Rules of the City of New York § 2-09, equipment of 2.8 million Btu/hr or more requires annual tune-ups and combustion-efficiency testing, with records kept for at least five years.
