Title 15 RCNY Chapter 1 governs the identification and abatement of asbestos-containing material (ACM) in NYC buildings, administered by the Department of Environmental Protection (DEP) under NYC Admin. Code Title 24, Subchapter 5. Before most demolition, alteration, or renovation construction-document approvals, a DEP-certified asbestos investigator must inspect the affected area and, where the area is ACM-free, the ACM will not be disturbed, or the work is a minor project (under 25 linear feet / 10 square feet), file a signed and sealed Asbestos Assessment Report (Form ACP-5) with DEP; larger asbestos projects require licensed handlers, work-area controls, and DEP variances. The current rules were amended effective May 28, 2022.
