Under NYC Admin. Code 28-117.1 it is unlawful to use or occupy any building or space as a place of assembly without a Place of Assembly Certificate of Operation issued by the DOB Commissioner; 28-118.12 separately provides that a certificate of occupancy does not authorize place-of-assembly use until that certificate is issued. A "place of assembly" is an indoor space (or roof/roof terrace) used by 75 or more people, or an outdoor space used by 200 or more. DOB reviews and inspects for Construction Code compliance and issues the Certificate of Operation, while FDNY issues and annually renews the place-of-assembly permit and inspects for Fire Code (FC403) compliance.
