Americans with Disabilities Act Title III, 42 U.S.C. § 12181 et seq.; 28 C.F.R. Part 36 (2010 ADA Standards for Accessible Design)
ADA Title III (42 U.S.C. § 12181 et seq.; 28 C.F.R. Part 36) prohibits disability discrimination in places of public accommodation and commercial facilities and requires newly constructed and altered facilities to comply with the 2010 ADA Standards for Accessible Design (the 2004 ADA/ABA Guidelines plus subpart D of 28 C.F.R. Part 36). It is a federal law enforced by the U.S. Department of Justice that applies to NYC commercial and retail properties independently of the NYC Building Code; the ADA does not preempt state or local codes that provide greater accessibility.
