N.Y. Labor Law §§ 240, 241
New York Labor Law § 240 (the "Scaffold Law") requires owners, contractors, and their agents to furnish or erect proper scaffolding, hoists, ladders, ropes, and other safety devices for workers performing elevated construction, demolition, repair, or related work, and New York courts apply an absolute, non-delegable liability standard for gravity-related injuries. Labor Law § 241 imposes additional safety duties for construction, excavation, and demolition work, including compliance with rules promulgated by the New York State Commissioner of Labor (the Industrial Code, 12 NYCRR Part 23). These are New York State statutes enforced primarily through private civil litigation, not regulations administered by the NYC Department of Buildings.
