NYC Admin Code § 28-305.4 (Local Law 37 of 2008)
NYC Administrative Code § 28-305.4 requires owners of retaining walls that are ten feet or more in height and front a public right-of-way to have a condition assessment performed at least once every five years by, or under the direct supervision of, a registered design professional with qualifications prescribed by the Department of Buildings. The professional must file a written report with the Department within sixty days of completing the assessment (and not more than five years after the prior report), certifying the wall as safe, safe with minor repair, or safe with repair and/or engineering monitoring.
