NYC Admin Code § 28-301.1.1; 1 RCNY § 103-15 (Local Law 126 of 2021)
Local Law 126 of 2021 added NYC Administrative Code § 28-301.1.1, requiring that every building with a parapet fronting the public right-of-way undergo an annual observation to confirm the parapet is stable and free of hazardous conditions, with exceptions for detached one- and two-family homes and buildings with a fence or other barrier preventing access to the exterior wall. The implementing rule, 1 RCNY § 103-15, took effect September 28, 2023, with the recurring observation obligation commencing January 1, 2024. Owners must retain the observation reports for at least six years and make them available to the Department of Buildings upon request.
