NYC Building Code (Title 28) Chapter 33 § BC 3301; § 3301.13.3
NYC Building Code Chapter 33 (BC 3301) governs all construction and demolition operations with regard to the safety of the public and property, and places duties to institute required safety measures on owners, construction managers, general contractors, and subcontractors (BC 3301.1.1, 3301.2). Section 3301.13.3 requires the permit holder to designate a primary construction superintendent, and notify the Department prior to commencing work, for new building construction, full demolition of an existing building, and alterations involving vertical or horizontal enlargement, alteration or demolition of more than 50 percent of the gross floor area over any 12-month period, removal of one or more floors over any 12-month period, or work requiring special inspection for underpinning or protection of the sides of excavations.
