NYC Admin. Code § 28-104.2.1
NYC Admin. Code § 28-104.2.1 authorizes the DOB Commissioner to establish a program under which construction and related documents may be accepted with less than full Department examination based on the professional certification of an applicant who is a registered design professional (a licensed professional engineer or registered architect). Under its subsections, a professional certification is a personal verification made under the professional's signature and seal attesting that the documents contain no false information and comply with all applicable law; acceptance of such documents has the same force and effect as approval after full examination (§ 28-104.2.1.1); and the Commissioner must exclude, suspend, or condition a professional's participation, after the opportunity for a hearing before the Office of Administrative Trials and Hearings, for knowingly or negligently certifying false or non-compliant documents (§ 28-104.2.1.3.2).
