NYC Administrative Code Title 24, Chapter 1 (§§ 24-101 et seq.) — Air Pollution Control Code
The Air Pollution Control Code, codified in Chapter 1 of Title 24 of the NYC Administrative Code and administered by the Department of Environmental Protection (DEP), regulates emission sources within the city. Owners must obtain a DEP Work Permit and Certificate to Operate for boilers and other combustion and process equipment, while qualifying mid-size boilers and water heaters (heat input of at least 350,000 but under 4,200,000 Btu/hr that do not require a Certificate to Operate) instead file a Registration under § 24-109. The Code imposes limits on smoke, particulate matter, the sulfur content of fuel, and other regulated air contaminants.
