Suffolk County Sanitary Code, Article 12 (§§ 760-1201 et seq.)
Suffolk County Department of Health Services regulation governing the storage and handling of toxic or hazardous materials to safeguard the county's federally designated sole-source aquifer (§760-1201). It prohibits discharge of such materials to land, groundwater, or surface water unless under a SPDES or other permit acceptable to the Commissioner (§760-1205), and defines toxic/hazardous materials by reference to federal lists (40 CFR Parts 116, 261, 302) and NYS lists (6 NYCRR Parts 371, 597, and 703.6) (§760-1203.N). It regulates storage facilities — defined to include tanks, pipes, vaults, and fixed containers (§760-1203.M) — requiring construction/modification and operating permits plus tank registration (§§760-1206, 760-1207) and design standards such as double-walled construction, product-tight integrity, and impervious secondary containment (§§760-1203.E/I, 760-1210, 760-1211). It also requires reporting of discharges, spills, leaks, and facility failures, and governs abandonment, substantial modification, and removal-from-service of facilities (§§760-1203.D/K, 760-1210.D/I, 760-1217).
