HUD's regulation implementing Section 109 of Title I of the Housing and Community Development Act of 1974 (42 U.S.C. 5309), prohibiting discrimination on the ground of race, color, national origin, religion, or sex in any program or activity funded in whole or in part with Title I federal financial assistance (including CDBG and Section 108 loan guarantees). Under Section 6.4, a recipient may not select the site or location of housing, accommodations, or facilities in a manner that has the purpose or effect of excluding persons, denying benefits, or defeating or substantially impairing the objectives of Section 109. Discrimination on the basis of disability is addressed separately under 24 CFR Part 8 (Section 504 of the Rehabilitation Act) and age under 24 CFR Part 146 (the Age Discrimination Act of 1975).
