Affirmatively Furthering Fair Housing (AFFH)

HUD regulations implementing the Fair Housing Act mandate (42 U.S.C. 3608(e)(5)) that HUD administer its programs to affirmatively further fair housing. Section 5.150 defines "fair housing" (housing that is affordable, safe, decent, free of unlawful discrimination, and accessible as required under civil rights laws) and "affirmatively further" (to take any action rationally related to promoting any attribute of fair housing); 5.151 provides that a program participant's AFFH certification is sufficient if, in the relevant period, it takes any action rationally related to promoting one or more attributes of fair housing under 5.150(a); 5.152 addresses AFFH certification and administration. A March 2025 HUD interim final rule (FR Doc 2025-03360, published March 3, 2025, effective April 2, 2025) returned the certification to its pre-1994 general-commitment form. The provisions are currently in effect.
