Westchester County Sanitary Code, Ch. 873, Art. X (Realty Subdivisions) (Part XI, §§ 873.931–873.1091)
Article X of the Westchester County Sanitary Code (Chapter 873, Part XI, §§ 873.931–873.1091) requires Westchester County Department of Health review and approval of every realty subdivision before land in it may be developed, sold, offered for sale, or built upon, to confirm adequate water supply and adequate sewage disposal and land drainage for each building site. The Department reviews the subdivision plan, maps, and supporting data, may require additional data and a test well on the site, and a Department-approved plan must be filed with the Westchester County Clerk to take effect. After a notice of violation, further development, sale, and construction of water or sewerage systems are prohibited until the violation is vacated in writing. The current consolidated Chapter 873 was approved August 5, 2025; Article X's substantive provisions have been effective since September 1, 1971 (one section amended effective April 1, 1987).
