Westchester County's freshwater wetlands law (Local Law No. 6 of 1976), codified at Chapter 358 of the Code of Ordinances (Part III). Under § 358.01, and pursuant to ECL § 24-0501 of the New York State Freshwater Wetlands Act (ECL Article 24), the County undertakes and exercises the State's regulatory authority over freshwater wetlands shown on the NYSDEC Freshwater Wetlands Map and over all adjacent areas within 100 feet of a wetland boundary, applying the procedures, concepts and definitions of ECL Article 24 (and Title 23 of Article 71 for enforcement). Because the chapter adopts the State Act's framework by reference, activities requiring a permit are those regulated under the Act (e.g., draining, dredging, excavation, removal of soil or other aggregate, filling, and erecting structures in or near a wetland). Note: Chapter 825 of the county code is the Source Separation/solid-waste law, not the wetlands law.
