N.Y. General Municipal Law § 239-n
Requires a municipal planning agency (in a county with an authorized county planning agency, such as the Westchester County Planning Board) to refer certain preliminary and final subdivision plats to that agency for review before final action. The county planning agency or regional planning council has 30 days after receipt to report its recommendations with reasons; if it fails to report, the referring body may act without the report. If the agency recommends modification or disapproval, the referring body may act contrary to that recommendation only by a vote of a majority plus one of all its members. Within 30 days after final action the referring body must file a report of its final action with the county planning agency, setting forth its reasons if it acted contrary to a recommendation of modification or disapproval.
