Westchester County Code Ch. 873 (Westchester County Sanitary Code), Art. VIII
The Westchester County Sanitary Code (Code Ch. 873), enforced by the County Board of Health and Department of Health under N.Y. Public Health Law §§ 309, 348-349, regulates sewerage, sewage and refuse disposal, water supplies, and realty subdivisions (Article VIII). The Department must approve every realty-subdivision plan's water, sewerage, and drainage methods before land is developed, sold, or any permanent building is erected (§ 873.951), and written approval from the Commissioner is required before constructing, installing, replacing, expanding, remediating, repairing, altering, or modifying an onsite wastewater treatment system (OWTS) (§ 873.726.A,B,D). No new OWTS may be placed in use, and no new building requiring such a system may be occupied, without first obtaining a certificate of construction compliance from the Commissioner (§ 873.726.J).
