N.Y. Real Property Law § 442-h (Art. 12-A)
Establishes the Secretary of State's rulemaking authority over real estate broker and salesperson conduct, including non-solicitation cease-and-desist zones that protect residential owners within a defined geographic area from intense and repeated solicitation (no zone rule effective longer than five years). It also mandates (subdivision 4) that every real estate broker date-stamp, notarize, and post a list of standardized operating procedures on each publicly available website and mobile device application it maintains; these procedures must address, at minimum, whether prospective clients must show identification, whether an exclusive broker agreement is required, and whether mortgage pre-approval is required (plus any further topics the Secretary sets by regulation). The standardized operating procedures requirement took effect April 20, 2022; alterations must be reposted within 30 days.
