N.Y. Real Property Law § 442-e (Art. 12-A)
Makes any violation of Article 12-A (real estate broker/salesperson licensing) a misdemeanor, prosecuted by the Attorney General, and, where the offender received money as commission, compensation or profit through the violation, exposes the offender to a civil penalty of not less than that sum and up to four times it, suable for and recoverable by any aggrieved person. For unlicensed persons violating §442-h, the Secretary of State may impose fines not exceeding $150 for the first violation, $500 for a second, and $1,000 for a third and each subsequent violation, with the Attorney General authorized to commence an action or proceeding on the Secretary's behalf.
