Petroleum Bulk Storage (Part 613)

6 NYCRR Part 613, promulgated under ECL Article 17 Title 10, governs petroleum bulk storage (PBS) tank systems at regulated facilities, with Subpart 613-2 establishing requirements for design/construction/installation, general operating practices, inspection and leak detection, spill reporting/investigation/confirmation, tank system closure, and operator training. Under §613-2.4 ("Reporting, investigation, and confirmation"), suspected leaks and spills must generally be reported to the NYS DEC Spill Hotline (800-457-7362) within two hours of discovery. Amendments effective October 17, 2023 broadened the parties subject to leak/spill reporting to include "any other party and its contractors who have been retained as part of a business transaction relating to the facility."
