Brownfield Cleanup Program (Part 375)

6 NYCRR Part 375 (Subpart 375-3); ECL Article 27, Title 14

The Brownfield Cleanup Program (BCP), authorized by ECL Article 27 Title 14 and implemented through 6 NYCRR Part 375 (Subpart 375-3), provides a voluntary cleanup framework with liability relief (via a Certificate of Completion) and tax credits for parties remediating contaminated property. Remedies are selected from four cleanup tracks (Track 1 unrestricted use through Track 4 site-specific restricted use), and restricted-use cleanups require recorded environmental easements and site management plans with institutional controls. DEC adopted revised Part 375 regulations effective December 31, 2025, conforming the rules to the 2015 and 2022 statutory amendments and updating soil cleanup objectives.
