6 NYCRR Part 375 (Subpart 375-2); ECL Article 27, Title 13
New York's State Superfund program, codified at ECL Article 27 Title 13 (ECL 27-1301 et seq.) and implemented through 6 NYCRR Subpart 375-2, requires DEC to maintain a registry of inactive hazardous waste disposal sites and to classify each site by the level of threat it poses (ECL 27-1305). DEC may compel responsible parties to develop and implement a department-approved remedial program at sites that pose a significant threat to public health or the environment, with cleanup-cost liability attaching to site owners and any person responsible for the disposal of hazardous waste, and the State able to recover its remediation expenses (ECL 27-1313). Revised Part 375 regulations took effect December 31, 2025.
