ISRA requires the owner or operator of an "industrial establishment" (a business with a NAICS code listed in the rule's Appendix C that operated in New Jersey on or after December 31, 1983 and handled hazardous substances) to investigate and remediate contamination in connection with a sale, transfer, closing, or cessation of operations. A General Information Notice must be filed with the NJDEP within five days of the triggering event, and the remediation is conducted under a Licensed Site Remediation Professional (LSRP). The failure of a transferor to comply with ISRA before a sale or transfer is grounds for the transferee to void the transaction and recover damages.
