These NJDEP rules govern the closure and remediation of discharges from unregulated heating oil tank systems, covering residential heating oil/fuel-oil tanks (including underground storage tanks) of any size and non-residential heating oil tanks with an aggregate capacity of 2,000 gallons or less. Discharges may be investigated and remediated by a qualified environmental professional (a Certified Subsurface Evaluator under N.J.A.C. 7:14B or a Licensed Site Remediation Professional) with limited NJDEP oversight, subject to possible audit. The rules also address financial assistance, including grants and loans available through the Petroleum Underground Storage Tank Remediation, Upgrade, and Closure Fund to offset remediation costs.
