Flood Hazard Area Control Act Rules
N.J.A.C. 7:13 (Flood Hazard Area Control Act Rules; N.J.S.A. 58:16A-50 et seq.)
These NJDEP rules regulate development within fluvial and tidal flood hazard areas, floodways, and riparian zones to minimize flood damage to life and property and to protect water quality. Most regulated construction, fill, or disturbance in a flood hazard area or riparian zone requires NJDEP authorization via a permit-by-rule, general permit (including general permit-by-certification), or individual permit, and new buildings are generally prohibited in the floodway.
