Freshwater Wetlands Protection Act Rules

N.J.A.C. 7:7A (Freshwater Wetlands Protection Act Rules; N.J.S.A. 13:9B-1 et seq.)

These NJDEP rules implement New Jersey's assumed federal Clean Water Act Section 404 program (NJ is one of only two states to have assumed the program), regulating disturbance of freshwater wetlands, State open waters, and adjacent transition (buffer) areas. Activities such as filling, excavation, or construction in regulated wetlands or transition areas require a freshwater wetlands permit (general permit-by-certification, general permit, or individual permit) or a transition area waiver from NJDEP.
