CWA 404(b)(1) Guidelines
40 CFR Part 230
The substantive EPA environmental criteria used to evaluate every Clean Water Act Section 404 permit application for the discharge of dredged or fill material. Under 40 CFR 230.10, no discharge may be permitted if a practicable alternative exists with less adverse impact on the aquatic ecosystem, and none may cause or contribute to significant degradation of the waters of the United States; appropriate and practicable steps must be taken to minimize potential adverse impacts on the aquatic ecosystem.
