NYC Admin. Code § 26-3102(l) (Short-Term Rental Registration; Prohibited Buildings List), added by Local Law 18 of 2022
Under Local Law 18 of 2022 (NYC Admin. Code § 26-3102(l)), the administering agency (the Mayor's Office of Special Enforcement) creates and maintains a Prohibited Buildings List of addresses whose owner — including a co-op/condo board, manager, or agent — has notified the agency that no short-term rental of any dwelling unit in the building is permitted. The agency's rules for inclusion require building owners to certify that leases and other occupancy agreements for units in the building prohibit short-term rentals, and OSE may not issue a short-term rental registration for any unit at a listed address (the list is published on the City's Open Data portal). Buildings where all units are prohibited under § 26-3102(d) are also included on the list.
