Duty to Keep Landmarks in Good Repair

N.Y.C. Admin. Code § 25-311

N.Y.C. Admin. Code § 25-311 requires every person in charge of an improvement on a landmark site or in a historic district to keep in good repair all exterior portions of the improvement and any interior portions that, if not maintained, may cause the exterior to deteriorate. For interior landmarks the person in charge must keep in good repair the interior landmark and other portions of the improvement affecting it, and for scenic landmarks must keep all portions in good repair; these duties are in addition to all other maintenance obligations imposed by law. The section is the statutory basis for the Landmarks Preservation Commission's "demolition by neglect" enforcement.
