Emergency Tenant Protection Act of 1974, Ch. 576, Laws of 1974 (N.Y. Unconsol. Laws §§ 8621-8634)
The Emergency Tenant Protection Act of 1974 (Chapter 576, Laws of 1974, codified at N.Y. Unconsolidated Laws §§ 8621-8634) authorizes rent stabilization where a municipality declares a housing emergency based on a rental vacancy rate of 5% or less. In New York City it brought buildings of six or more units built between March 10, 1969 and December 31, 1973 under rent stabilization and ended 1971-1974 vacancy decontrol, and it is the statutory basis for stabilization in municipalities in Nassau, Westchester, and Rockland counties and the City of Kingston (with eligibility expanded statewide by the HSTPA of 2019).
