N.Y. Town Law § 274-b
Authorizes a town board to empower the planning board or another designated administrative body to grant special use permits — defined as authorization of a particular land use that is permitted in the zoning ordinance or local law, subject to requirements imposed by that ordinance to assure the use is in harmony with it and will not adversely affect the neighborhood. The authorized board may impose reasonable conditions and restrictions directly related and incidental to the proposed use, must hold a public hearing within 62 days of receiving an application, and must decide within 62 days after the hearing, mailing notice to the applicant and the county planning board or agency at least 10 days before the hearing.
