N.Y. Town Law § 274-a
Authorizes a town board to empower the planning board (or another designated administrative body) to review and approve, approve with modifications, or disapprove site plans for proposed land uses. The reviewing board may impose reasonable conditions and restrictions, require park reservation or a sum of money in lieu thereof for residential plats, and require a performance bond or other security for required infrastructure improvements. Applicants may seek an area variance from the zoning board of appeals, and a board decision is subject to court review by Article 78 proceeding instituted within thirty days after the decision is filed with the town clerk. Developers must obtain site plan approval where the local zoning law requires it.
