RPAPL § 1306 (Pre-Foreclosure Filing)

N.Y. Real Property Actions and Proceedings Law § 1306

RPAPL § 1306 requires every lender, assignee, or mortgage loan servicer to file a pre-foreclosure information form electronically with the Superintendent of Financial Services within three business days of mailing the RPAPL § 1304 90-day pre-foreclosure notice. The filing must include the borrower's name, address, and last known telephone number, the amount claimed as due and owing on the mortgage, and such other information as will enable the Superintendent to ascertain the type of loan at issue, so DFS can monitor foreclosure filings statewide and direct foreclosure-prevention services to at-risk borrowers.
