N.Y. Real Property Actions and Proceedings Law § 1304
RPAPL § 1304 requires a lender, assignee, or mortgage loan servicer to send the borrower a 90-day pre-foreclosure notice, in at least 14-point type, before commencing a foreclosure action on a "home loan" (a mortgage on a 1-4 family owner-occupied principal residence in New York). The notice must state the amount and number of days the loan is in default, warn that the borrower may be at risk of losing the home, and attach a current list of at least five government-approved housing counseling agencies serving the county. Strict compliance is a condition precedent to commencing a foreclosure, and failure to comply results in dismissal of the foreclosure action.
