N.J.S.A. 46:8-50
Every landlord must notify each tenant, prior to lease signing or renewal, whether the rental property is located in the FEMA Special Flood Hazard Area ("100-year floodplain") or Moderate Risk Flood Hazard Area ("500-year floodplain"), and must disclose any actual knowledge that the rental premises or its parking areas have flooded. Disclosure must be in writing before the lease is signed (in residential leases, via a separate rider in at least 12-point type, signed by the tenant), using the model "Flood Risk" notice developed by the NJ Department of Community Affairs. The duty applies to landlords renting commercial space or residential dwellings, excluding premises with no more than two units, owner-occupied premises of no more than three units, hotels/motels/guest houses serving transient or seasonal guests, and seasonal rentals of less than 120 days.
