N.J.S.A. 40:55D-37
Authorizes a municipal governing body, by ordinance, to require approval of subdivision plats and site plans by resolution of the planning board as a condition of filing plats or issuing development permits (with detached one- and two-dwelling-unit buildings exempt from site plan review). Before adopting or amending such an ordinance, the governing body must refer the proposed ordinance or amendment to the planning board, and applications subject to county review must also be submitted to the county planning board. This section is the foundation of municipal subdivision and site plan review under Article 6 of the Municipal Land Use Law.
