N.J.A.C. 5:28A (implementing P.L.2021, c.182; chapter authority N.J.S.A. 52:27D-437.20a and 52:27D-437.17b)
Implementing P.L.2021, c.182, rental single-family, two-family, and multiple dwelling units built before 1978 must be inspected for lead-based paint hazards every three years or upon tenant turnover, whichever is earlier. The inspection is a visual assessment in municipalities where fewer than 3% of children age 6 or younger tested have a blood lead level of at least 5 micrograms per deciliter, and dust-wipe sampling where that rate is 3% or higher. When no hazard is found the unit receives a lead-safe certification, valid for two years, that exempts the dwelling from turnover inspections during that period; identified hazards must be remediated by the owner through abatement or interim controls.
