N.J.A.C. 5:23-8.5
Under the Asbestos Hazard Abatement Subcode (N.J.A.C. 5:23 Subchapter 8), the removal, replacement, repair, enclosure, or encapsulation of friable asbestos-containing material is treated as construction work, and it is unlawful to undertake an asbestos hazard abatement project unless the owner first applies to and obtains a construction permit from the enforcing agency (the DCA or an authorized municipality) before the project begins. The permit application must reference the asbestos contractor's Department of Labor license (N.J.A.C. 12:120) and a hazard assessment tied to Department of Health accreditation standards (the subcode coordinates with the jointly adopted DOH N.J.A.C. 8:60 and DOL N.J.A.C. 12:120 licensing and worker-permit rules).
