This Uniform Construction Code rule (adopted effective Sept. 18, 2023), which incorporates the requirements of P.L. 2021, c.171, requires new buildings with five or more dwelling units in Groups R-2 or R-3 to designate at least 15 percent of approved off-street parking as electric vehicle make-ready spaces and to provide electric vehicle supply equipment (EVSE) at one-third of those make-ready spaces; the underlying statute phases in the remaining EVSE so that an additional one-third is installed within three years and the final one-third within six years of occupancy. Other new buildings must provide make-ready spaces on a tiered schedule based on parking count (1 space at 25-50 spaces, 2 at 50-75, 3 at 75-100, 4 at 100-150, and 4 percent above 150). At least 5 percent of EVSE-served spaces, and not fewer than one per type of charging system, must be accessible.
