N.J.A.C. 5:23-2.23
A building or structure hereafter erected may not be used or occupied, in whole or part, until a certificate of occupancy is issued by the construction official. Renovated or altered buildings require a certificate of approval before occupancy, while reconstructed buildings and additions that increase a building's height or area require a certificate of occupancy. The construction official may issue (and renew) a temporary certificate of occupancy when permitted work is substantially completed and the building or portion can be occupied safely prior to full completion.
