Under the NYC Housing Maintenance Code, an owner may not harass tenants or other persons lawfully entitled to occupancy. Section 27-2004(a)(48) defines "harassment" as acts or omissions intended to cause a lawful occupant to vacate or to surrender or waive occupancy rights, enumerating prohibited conduct such as using force or threats of force, repeated interruption or discontinuance of essential services, repeated unwarranted contact, commencing repeated baseless or frivolous court proceedings, buyout-offer abuses, and other repeated acts that substantially interfere with the comfort, repose, peace or quiet of an occupant. Section 27-2005(d) makes such harassment a violation of the owner's duties.
