N.Y. Real Prop. Acts. Law (RPAPL) §§ 711, 731, 733, 749, 768
RPAPL Article 7 governs the only lawful process to evict a residential tenant in New York, including NYC: a nonpayment proceeding requires a written 14-day rent demand (RPAPL § 711(2)) and a holdover proceeding follows from a tenant remaining after the term expires (RPAPL § 711(1)) with a predicate termination notice, after which the notice of petition and petition are issued and served under §§ 731 and 733 (service 10-17 days before the hearing). Self-help eviction is prohibited (RPAPL § 768, a class A misdemeanor) and a tenant may only be removed by a warrant of eviction executed by a marshal or sheriff after a court judgment of possession (RPAPL § 749).
