Harassment Civil Penalty
NYC Admin. Code § 27-2115(h), (m)
Under NYC Admin. Code § 27-2115, a violation of the tenant-harassment duty in § 27-2005(d) is classified as a class C immediately hazardous violation (subsection (m)). A tenant or group of tenants who claims harassment under § 27-2005(d) may apply to the housing part of Housing Court (an HP proceeding) for an order directing corrective action (subsection (h)), and the court may impose civil penalties on the owner and issue a restraining order barring further violation.
