NYC Admin. Code § 27-2093
Under NYC Admin Code § 27-2093, before an owner of a single room occupancy multiple dwelling may obtain a permit to alter or demolish the building, HPD's commissioner must certify that there was no harassment of the lawful occupants during the 36-month period prior to the certification application; the companion permit-bar provisions (§§ 27-198 and 27-198.2) require DOB/HPD to reject the alteration or demolition permit if certification is denied. The section provides for a waiver in limited circumstances (e.g., where the owner was not responsible for the harassment) and for rescission if harassment occurs after issuance, and conditions any certification or waiver on a sworn statement by all owners that there will be no future harassment.
