NYC Admin. Code § 27-2093.1
Under the Certification of No Harassment (CONH) Pilot Program (established by Local Law 1 of 2018 and extended/amended by Local Law 140 of 2021, in effect through September 27, 2026), HPD designates qualifying "pilot program buildings" under NYC Admin. Code § 27-2093.1 based on distress and enforcement criteria. For such buildings, the Department of Buildings will not approve construction documents or issue permits for covered work — demolition or a change of use or occupancy of dwelling units — unless the owner first obtains an HPD certification of no harassment (or a waiver/restrictive declaration); the relevant DOB approval bar is codified in NYC Building Code Article 505 (§§ 28-505.x), not § 27-2093.1 itself. A denial or rescission bars the covered permits for 60 months unless the owner enters a cure agreement under § 27-2093.1(e), which can require a low-income housing set-aside (recorded via restrictive declaration).
