Since Local Law 10 of 2008, the NYC Human Rights Law (N.Y.C. Admin. Code § 8-107(5)) prohibits landlords, owners, and brokers from refusing to rent, lease, or sell, or otherwise discriminating, because of an applicant's lawful source of income. "Lawful source of income," defined in § 8-102, includes income from social security and any form of federal, state, or local public assistance or housing assistance, including Section 8 vouchers (the Commission lists examples such as SSI, HASA, and CityFHEPS). Publishing advertisements or statements expressing a limitation or discrimination based on lawful source of income is also unlawful under § 8-107(5).
