N.J.A.C. 11:5-6.1
Governs all real estate advertising by New Jersey licensees, requiring ads to include the broker's regular business name (the name on record with the Real Estate Commission) and to clearly indicate the advertiser is engaged in the real estate brokerage business. Mandates specific disclaimers, including "In New Jersey commissions are negotiable" when commissions are referenced and "to a qualified buyer" for down-payment or mortgage offers, requires identification of the property's municipality and a franchise "each office is independently owned and operated" statement, and prohibits false, misleading, or discriminatory advertising as well as advertising a property as sold before closing (requiring "under contract" in the interim).
