43 RCNY Chapter 14, Subchapter 1 (§§ 43-1401 et seq.) — NYC Voluntary Cleanup Program (OER Program Rule)

OER's Voluntary Cleanup Program (VCP), codified in 43 RCNY Chapter 14, Subchapter 1, lets owners and developers enroll lightly-to-moderately contaminated NYC sites for OER-supervised investigation and remediation. OER reviews and approves the site's Remedial Action Work Plan and oversees the cleanup; upon issuing a Notice of Completion, the volunteer receives a New York City liability release and becomes eligible for the city's Brownfield Incentive Grant program. The VCP is the local-brownfield pathway used alongside or instead of the New York State Brownfield Cleanup Program.
